Seniors over 55 are the fastest growing segment of property owners in our nation, and the bulk of their personal wealth is invested in real estate. Many Seniors have not invested in or sold real estate property in many years and, consequently, they have special issues and requirements affecting them. They need to know how they should go about protecting and increasing their equity. Changes in lifestyle and personal situations can often occur quickly and dramatically. Good real estate planning is one of the most important issues Seniors should address now for their financial security.
I believe that education has been vital to my consistent success in real estate. Having received additional training through The Senior Advantage Real Estate Council and awarded the designation of "Seniors Real Estate Specialist" has given me the opportunity as a Realtor to focus my business on Seniors and to consult with them about their options regarding real estate issues. (Helping People Meet Aging-Related Legal and Care Challenges), the Peninsula Seniors, and PVE CARES (Palos Verdes Estates Community Assistance and Resources for the Elderly and Seniors) under the direction of the Palos Verdes Estates Police Department.

The following are brief definitions of the levels of care available to Seniors:
INDEPENDENT/SENIOR LIVING
Also known as retirement living, independent living communities provide housing for Seniors who don't need assistance.
Offered as studio, one-bedroom, and two-bedroom apartments which include safety features such as grab bars in the bathrooms, and emergency pull cords and/or intercom system. Services typically include meals, housekeeping, planned recreational and social activities, shuttles to stores, doctors' offices, etc. Some communities have a beauty/barber shop and other amenities. Keeping Seniors acitve is the key here.
ASSISTED LIVING
Assisted Living communities are for Seniors who don't need skilled medical care but do need help with certain activities of daily living, such as bathing and dressing. Assisted living can also offer some supervision for forgetfulness and short-term memory loss. Most states have licensing requirements for assisted living communities.
Assisted Living communities vary widely in size, from ten residents to hundreds. They typically provide private apartments or private and semiprivate rooms, common areas for socializing and recreation, planned activities, three meals and snacks and 24-hour staffing. The activities and common areas provide social contact that can help many Seniors avoid isolation and depression. To meet individual Seniors' needs, these communities also offer some personalized support services, such as meals brought to a person's room when ill, shuttles for errands, housekeeping and laundry service and emergency monitoring systems.
ASSISTED LIVING HOMES
Some Seniors who need Assisted Living services prefer smaller or more personalized options, such as a Board and Care home. These are homes in a residential area that provide room, meals and some supervision, but no nursing care. They may offer recreational and social activities for residents as well as assistance with personal care, similar to the Assisted Living Communities.
ALZHEIMER'S/DEMENTIA
Theses facilities are very similar to both Assisted Living and Board and Care homes, but they are structured for memory-impaired Seniors who cannot normally take care of themsleves. They provide constant supervision, help with activities of daily living, personalized care and additionally give residents as much mental and memory stimulation as possible. Well-designed communities are staffed with professionals trained to care for Alzheimer's and dementia residents.
SKILLED NURSING
Skilled Nursing provides comprehensive care for people with medical needs that require attention by a licensed nurse. Although most Seniors and families view nursing home care as a last resort, these facilities may by the best choice for individuals requiring multiple types of services.
Along with providing 24-hour care, dietitians, rehabilitaion therapists and other health care professionals work to support and sustain Seniors' physical and emotional well-being. Physicians follow residents to skilled nursing homes and visit regularly.
ADDITIONAL SERVICES
Day Care Centers - Another wonderful tool when keeping someone in their own home. Services are typically activities recreational and social. A meal or two may also be included.
Home Health Agencies - A good service when keeping someone in their own home and/or addition to services currently rendered by Independent Living and/or Assisted Living. There are agencies available for medical and non-medical services such as companion care.

"NO BURST IN THIS HOUSING BUBBLE!"

Keeping tabs on the housing market can feel a lot like listening to the "Chicken Little" story over and over again. Month after month, as interest rates rise and building starts stumble, we hear that the sky is falling. But every month, home sales continue at a healthy clip, buyers still get loans, and the sky stays up!
Our faith in the sky, however, was severely shaken last week when former Federal Reserve Chairman Alan Greenspan and his successor, Ben Bernanke, in separate speeches, announced the end of the housing boom nationally. They are certainly correct that the market is slowing. But the sky still isn't falling.
The history of the boom is familiar by now. Lured by low interest rates and adjustable-rate financing, Americans bought real estate in the '00s the way they bought tech stocks in the '90s, pushing prices to levels that would have seemed nuts just a few years before. Or a few months before. In the first half of 2005, the median price of a house in California jumped 12% to $542,720. Five years earlier, it was $244,230.
Bearish pundits have been saying the end was nigh for years, but now more numbers are turning in their favor. So far this year mortgage delinquencies are rising nationwide, a sign that borrowers may be having trouble keeping up with rising adjustable-rate loan payments. Houses now sit on the market for weeks or months instead of days. In April, sales in Southern California dropped 21.3% from the year before - more precipitously than they had in 11 years. Prices haven't followed suit, but they are leveling off.
So why do we think the sky isn't falling? Economists disagree on how large the decline ultimately could be. Some say prices will remain level; others think they could fall as much as 30%. Whatever the damage, it could take many years to play out. There's also a big difference between mortgage delinquency and default. Barring a major recession, most homeowners should be able to hunker down and hang on to their property long enough for incomes to catch up with price levels.
In other words, unless you're a real estate agent, mortgage broker, builder or go-go speculator - and nowadays, we realize, that includes a distressingly large number of people - this housing slump isn't going to bonk you on the head like a falling acorn.
What's more, though it's a detail that's often overlooked in a town that fetishizes homeownership, most Angelenos are renters. According to U.S. census data, more than 60% of people in Los Angeles rent their residences. So if prices do start to fall precipitously, there may be a lot of potential buyers on the sidelines waiting to pounce!

STAGING YOUR HOME
The way you live in your home and the way we sell your house are two different things!
When you get ready to place a home on the market for sale it becomes a product, and just like any product on the shelves at your local store it has features and benefits, pluses and minuses, and there are other products to compete with. To gain an edge in your marketplace you must be priced right and look better than the competition. Sometimes it's difficult to think of a home as a mere product, but it helps to think that way in order to get top dollar for the home and sell it in a reasonable amount of time.

HISTORY OF PALOS VERDES
The rich and colorful heritage of Palos Verdes begins with the tribes of Gabrielino Indians who originally lived on the Palos Verdes Peninsula and who were first described by the Spanish explorer Cabrillo in 1542. The area was taken under Spanish rule by the armies under Cortez and remained under Spanish rule, virtually undisturbed, until Mexico won its independence from Spain in 1822. In 1827 the Governor of Mexican California reqarded Don Dolores Sepulveda for his military services by giving him a land grant of the "Rancho de los Palos Verdes (Ranch of the Green Trees)". The Sepulveda family operated a flourishing cattle ranch until drought and boundary litigation resulted in the great rancho being awaraded to Jotham Bixby. As land values grew and it was no longer possible to continue cattle ranching, Bixby leased the land to Japanese farmers for cultivation of flowers, vegetables and grains.
In 1913 a group of New York investors purchased most of the land intending to develop a community of large estates for the wealthy. It was not until 1921, however, that Frank A. Vanerlip, Sr., one of the New York investors, and E.G. Lewis, a real estate promoter, founded the Palos Verdes Estates Project. In 1924 the first houses appeared and the rancho, through the course of time, was divided into the present-day cities of Palos Verdes Estates, Rolling Hills, Rolling Hills Estates, and Rancho Palos Verdes.
THE COMMUNITIES OF PALOS VERDES
Each suburban, residential community on the Palos Verdes Peninsula enjoys its own special environment. Median annual household incomes vary from $90,000 to $150,000 in various parts of the Palos Verdes Peninsula. The total Palos Verdes population of approximately 73,000 is distributed among four cities and two unincorporated areas that have evolved with distinctive characterics shpaed by the terrain and the time and circumstances of development. Incorporated in 1973, Rancho Palos Verdes is the fourth, newest and largest municipality on the Palos Verdes Peninsula. It was established by strong community action to prevent the over-development destined to occur if planning had taken place under Los Angeles County control.
Upwards of 45,000 residents live in primarily single-family homes in a 13 1/2 square mile area. Homes in the city of Rancho Palos Verdes are composed of individual homes, condominiums, and town homes that encompass a wide range of size and price. Many of the homes enjoy magnificent views of the ocean, mountains and city lights of the Los Angeles basin.
The 7 1/2 mile coastline has a striking topography of quiet coves and beaches protected by steep cliffs. Rolling Hills Estates, bordered by the city of Torrance to the northeast and virtually surrounded by the city of Rancho Palos Verdes to the south and west, may be the only Southland community where City Hall has a hitching post for the convenience of its visitors. It enjoys an equestrian lifestyle, yet it encompasses the Peninsula Center, the major commercial area of Palos Verdes, with one million square feet of office and retail space.
The roughly 8,000 residents in this semi-rural city located on 4.18 square miles of hilly terrain on the northern side of the Palos Verdes Peninsula have a closely-knit community. They take pride in their 25 miles of equestrian, off-road bicycle and jogging paths, and panoramic views of Santa Monica Bay extending to downtown Los Angeles and the San Pedro Harbor.

Privacy and serenity characterize life in Rolling Hills, an entirely gated city with private roads and three guarded gates. Access to the city is by permit and guests must be authorized to a gate officer, from a resident, for entrance. Rolling Hills is considered to be one of the most beautiful residential communities in the world.
Rolling Hills is an equestrian city where many families have traditionally kept horses on their properties. It has an extensive 23 mile private trail system, and the RHCA provides the community with two riding rings (Hesse Gap and Poppy Trail). There are also three tennis courts at the main gate location.
Most of the homes are only one story high, on one-to-five-acre estates, and all are painted the "approved" white in keeping with the Rolling Hills Community Association rules. There are no street lights or sidewalks in the city and outdoor lighting is limited.
About 2,000 residents live on 1,889 acres in the center of the Peninsula, a three-square mile area of homes, hills and canyons, all protected by the three guarded entrances. With few exceptions, the smallest parcel of land here is one acre, with parcels of two or more acres available among the approximately 700 sites in Rolling Hills. These properties are prized by those who seek breathtaking ocean, mountain, city lights and canyon vistas, open land for horses, and a serene tempo to life. There are no zones for commmerce in the city of Rolling Hills.
The Rolling Hills Community Association's annual residential assessment is based upon .20 cents per hundred dollars of the assessed valuation of the property established by Los Angeles County, payable twice a year.
Residents experience the gracious "country" lifestyle, while enjoying the serenity of the surrounding natural beauty in one of the most prestigious locations in the world.

The two-block-long, recently relandscaped park is the centerpiece of an area referred to as Upper Vista Del Oro. With views that are at a pleasant remove from the actual traffic of the port, it has long been a destination of choice for upwardly mobile locals, Many are still here, and the neighborhood has a dreamy, old-fashoned air. Well-preserved Spanish and Tudor style cottages dating from the 1930s line many streets, and the shopping block at 8th and Weymouth offers free angle parking. Lomita, Spanish for "little hills", was originally a cattle ranch owned by the Sepulveda family. Over time the land was sold off and eventually ended up in the hands of the W.I. Hillingsworth Company in 1907. The intent was to build a Dunkard colony for the Los Angeles area. Two decades later, the population slowly grew and property values boomed, due to the discovery of oil.
As the 1930s came around, farming became a major industry for the area and Lomita became known as the "Celery Capital of the World." On June 30, 1964, Lomita was incorporated as a city. It still continues to maintain its rustic small town feel and a desirable place to live.

WHAT IS AN ESCROW?
An escrow is an arrangement in which a disinterested third party, called an escrow holder, holds legal documents and funds on behalf of a buyer and seller, and distributes them according to the buyer's and seller's instructions. People buying and selling real estate often open an escrow for their protection and convenience. The buyer can instruct the escrow holder to disburse the purchase price only upon the satisfaction of certain prerequisites and conditions. The seller can instruct the escrow holder to retain possession of the deed to the buyer until the seller's requirements, including receipt of the purchase price, are met. Both rely on the escrow holder to carry out faithfully their mutually consistent instructions relating to the transaction and to advise them if any of their instructions are not mutually consistent or cannot be carried out.
An escrow is convenient for the buyer and seller because both can move forward separately but simultaneously in providing inspections, reports, loan commitments and funds, deeds, and many other items, using the escrow holder as the central depositing point. If the instructions from all parties to an escrow are clearly drafted, fully detailed and mutually consistent, the escrow holder can take many actions on their behalf without further consultation. This saves much time and facilitates the closing of the real estate transaction.
There are two important reasons for selecting an established escrow company. One is that real estate transactions require a tremendous amount of technical expertise and knowledge to handle properly. The other is that the escrow holder will generally be responsible for safe-guarding and accurately distributing the purchase price in accordance with instructions handed them.
Escrow Officers with established firms are experienced and trained in real estate procedures, title insurance, taxes, deeds, and Federal and State regulations.
An escrow officer must remain completely impartial throughout the entire process. He or she will normally adopt a courteous but rather formal manner when dealing with parties to the escrow, because the escrow office must follow the instructions of both parties without bias.
WHAT ARE ESCROW INSTRUCTIONS?
Escrow Instructions are written documents, signed by the principals to the transaction, which direct the escrow officer to perform specific steps to be completed prior to the close of escrow. Typical instructions would include the following:
- the method by which the escrow holder is to receive and hold the purchase price to be paid by the buyer
- the conditions under which a lapse of time or breach of purchase contract provision will terminate the escrow without a closing
- the instruction and authorization to the escrow holder to disburse funds for recording fees, title insurance policy, real estate commissions, and any other closing costs incurred through escrow
- instructions as to the proration of insurance and taxes
- instruction to the escrow holder on the payment of prior liens and charges against the property and distribution of the net sale proceeds
Because the escrow holder can only follow the instrucitons as stated, and may not exceed them, it is extremely important that the instructions be stated clearly and be complete in all details.
WHAT THE SELLER DOES IN THE ESCROW PROCESS:
- executes all escrow instructions
- deposits the executed deed to the buyer with escrow holder
- deposits or causes to be deposited other documents as required by the Purchase Agreement or the escrow instructions. This may include, but not necessarily limited to, all documents to transfer and/or clear title to the buyer, evidence of termite inspection with the Notice of Completion, home warranty contract, city requirements (if any) and Federal and/or State requirements.
WHAT THE BUYER DOES IN THE ESCROW PROCESS:
- executes all escrow instructions
- approves any inspection reports, preliminary report of title, etc., as called for in the Purchase Agreement or escrow instructions
- executes any Deed of Trust necessary to secure the loan(s) on the property
- deposits funds for the down payment, plus funds required to pay costs and causes any borrowed money to be deposited with escrow holder to complete the purchase price.

- Sellers: How to choose a Realtor
Finding the right real estate professional requires doing a little research and asking a few pertinent questions. You need to know as much as you can about the selling process. I suggest that you interview three agents. Be prepared to ask the following questions of the agents you interview:
- What is the marketing strategy?
- What kind of advertising will be done?
- Is the Realtor capable and willing to communicate effectively and often?
- Can the Realtor effectively present and sell the less-noticeable assets of the property?
- Is the Realtor capable of 'staging' the home for sale?
- Can the Realtor recommend and coordinate any work that needs to be done to make the property more saleable?
- Does the Realtor have testimonials of home sellers of the previous sales of homes in the area?
- Does the Realtor have a team of real estate related professionals who can help to make the sale of the property go smoothly?
Real estate professionals also need to be knowledgeable about the community. They need to have a feel for the history of the area and the approximate price that people will be willing to pay. Also, real estate agents should know what the competition is and how much it will effect your sale.
NEVER choose a Realtor based on price alone. Remember that a Realtor cannot magically raise the selling price of the house. Consider the buyer. The purchaser won't willingly pay too much; it's most likely that the buyer will do research on the market and try to find the best product for the best price. The facts simply cannot be changed, no matter which Realtor you select. In spite of these unchangeable factors, the Realtor you select must still be diligent and knowledgable.
If your property does not elicit attention within several weeks, the cause can most likely be attributed to one of these three factors: location, condition, and price. The location obviously cannot be changed. You should consider examining the conditioning of your property and reevaluating the marketing strategy. Ask your Realtor to offer an explanation of the competition and your pricing strategy.
